Childless Man Forced to Pay Child Support

Talk about getting screwed! Frank Hatley just spent the past year in jail for non-payment of child support, but he has no children! He was released, with the help of the Southern Center for Human Rights, because he is indigent and therefore cannot afford to pay the child support.

Back in 1986 Hately had a relationship with a woman who became pregnant and gave birth to a son. She told Hatley that the child was his. Soon thereafter they split up. The mother applied for public assistance for her son when he was 2-years old, and the state went after Hatley for child support. He paid child support for 13 years until 2001 when he learned through a DNA test that the boy was not his. At that time he went to court and was relieved of any responsibility from that point out. However, the court said that he still had to pay $16,000 that he owed before the ruling. Seriously, how fucked up is that?!?

Hatley has tried like hell to continue making payments, even when unemployed and homeless. He was jailed in 2006 for six months for falling behind on payments and then again last year when he was unable to make payments.

Now, this man did the responsible thing. He thought the child was his and paid child support. After 13 years of making payments he learned that the child was in fact not his. At that point he should have been relieved of any and all responsibility to that child. It’s not his child! Seriously, how do you force someone to support a child that isn’t theirs? That is way beyond fucked up! Now he’s waiting for the judge’s ruling on whether or not he still has to pay the rest of the money he supposedly owes. If justice were to be served he would not owe another penny for this child. And to be fair, the mother should have to pay him back every single penny that he paid for her child. She’s the one that claimed he was the father, well let her take responsibility for her actions now just like he did all those years.
